1. Acceptance of Terms

By accessing or using Inplay School of Music’s services or website, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our services.


2. Lesson Scheduling and Attendance

  • Lessons may be conducted in-person or online based on student choice and teacher availability.

  • Students must arrive on time; late arrivals result in loss of lesson time without extension.

  • Regular weekly lesson times are reserved; changes or cancellations require at least 24 hours’ notice.

  • Missed lessons without proper notice are forfeited and not refundable or make-up eligible.

  • Teacher cancellations will be rescheduled or credited.


3. Payment Terms

  • Payments are due as per your selected plan: monthly, semesterly, or annually.

  • Accepted payment methods include Zelle, checks, credit/debit cards, PayPal, Stripe, and cash.

  • Payments received after the 5th of the month may incur a $25 late fee.

  • Automatic monthly payments may be set up and will be processed on the 1st of each month.


4. Refund Policy

  • Refund requests require written notice at least 30 days before the refund date.

  • Refunds only apply to unused prepaid lessons and are subject to approval.

  • Processing or administrative fees may be deducted.

  • Refunds are issued within 10–14 business days via the original payment method.


5. Discounts

  • Sibling Discount: 10% off tuition when multiple siblings enroll for a full year; if one withdraws, remaining siblings lose the discount.

  • Annual Prepayment Discounts: $20 off for 30-minute lessons, $30 off for 45-minute lessons, and $40 off for 60-minute lessons with full annual prepayment of 48 lessons.


6. Referral Program

  • Open to current students only.

  • Referrer receives a free month (4 lessons of 45 minutes) after the new student completes 3 months.

  • No limit on referrals; referrals must be declared at new student enrollment.

  • Free lessons cannot be exchanged for cash or other services.

  • The program may be modified or terminated at any time.


7. Code of Conduct and Equipment Use

  • Students, parents, and guardians must act respectfully toward instructors, staff, and other students.

  • Disruptive, aggressive, or unsafe behavior may result in immediate termination of lessons without refund.

  • Parents/guardians are responsible for the conduct and supervision of minors before and after lessons.

  • Students are expected to care for any equipment or materials provided; damages caused by negligence may incur repair or replacement fees.

  • Use of personal instruments or equipment must be approved by the instructor.


8. Privacy and Media Consent

  • By enrolling, you grant Inplay School of Music the right to record lessons, recitals, and events involving the student for educational, promotional, or archival purposes.

  • Photos, videos, or recordings may be used on our website, social media, newsletters, or marketing materials unless you notify us in writing to opt-out.

  • We commit to protecting your personal data in accordance with our Privacy Policy.


9. Intellectual Property

  • All lesson materials, recordings, videos, and digital content remain the exclusive property of Inplay School of Music or its instructors.

  • Unauthorized copying, distribution, or resale of these materials is strictly prohibited.


10. Website Use

  • Use of the website must be lawful and respectful.

  • Cookies and tracking may be used as described in our Privacy Policy.

  • All website content is protected by copyright and trademark law.


11. Limitation of Liability

  • Inplay School of Music is not liable for indirect, incidental, or consequential damages.

  • We are not responsible for events beyond our control, including but not limited to weather, natural disasters, power failures, internet disruptions, or public health emergencies.

  • Liability for any claim shall not exceed the amount paid for services in the three months prior to the claim.


12. Force Majeure

  • We shall not be liable or responsible for any failure to perform, or delay in performance, due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, government restrictions, pandemics, strikes, or power failures.


13. Termination

  • We reserve the right to terminate services at any time for non-payment, repeated no-shows, misconduct, or breach of these Terms.

  • Refunds for unused lessons upon termination are at our sole discretion.


14. Arbitration and Dispute Resolution

  • Any disputes arising under these Terms shall first be subject to good faith mediation.

  • If unresolved, disputes will be resolved by binding arbitration conducted in Denton County, Texas, under the rules of the American Arbitration Association.

  • Arbitration decisions are final and binding, and judgment may be entered in any court having jurisdiction.


15. Changes to Terms

  • We may update these Terms and Conditions at any time.

  • Updated Terms will be posted on our website and become effective immediately.

  • Continued use of our services constitutes acceptance of the updated Terms.


16. Governing Law and Venue

  • These Terms are governed by the laws of the State of Texas.

  • Venue for any legal action will be in Denton County, Texas.
